Copyright Policy and DMCA Process

Guap.lol respects the intellectual-property rights of others and expects everyone using Guap to do the same. This policy explains how copyright owners can report alleged infringement, how affected users can submit counter-notices, and how we address repeated infringement.

This policy applies to copyright complaints involving content made available through guap.lol, including public profiles, links, uploaded media, images, customizations, and other user-provided materials.

Guap reviews copyright complaints under the Digital Millennium Copyright Act, or DMCA, where it applies, as well as other applicable copyright laws.

This policy is not legal advice. Copyright law can be complicated, and submitting a knowingly false claim or counter-notice can create legal consequences. If you are uncertain whether content infringes your rights, is authorized, or qualifies for an exception such as fair use, you should consult a qualified attorney before filing a notice.

1. Designated Copyright Agent

Copyright submissions must be sent by email unless Guap provides a different submission method. We may decline, delay, or request more information about notices that do not substantially satisfy the requirements below.

2. Filing a Copyright Infringement Notice

If you believe that content hosted on or available through Guap infringes a copyright that you own or are authorized to enforce, you may send a written notice of claimed infringement to our designated copyright agent.

Your notice should include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act for the owner.
  2. A description that clearly identifies the copyrighted work you believe has been infringed. If a single notice concerns multiple works, you may provide a representative list.
  3. The exact Guap URL or URLs where the allegedly infringing content is located, with enough detail for us to identify and locate each item.
  4. Your full legal name and reliable contact information, including an email address. Include a mailing address and telephone number where required by applicable law.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the copyright owner.

By submitting a notice, you acknowledge that Guap may provide the notice, including your contact information, to the user who posted the material. We may also retain, disclose, redact, summarize, or publish notice-related information where reasonably necessary for legal compliance, dispute resolution, transparency, enforcement, security, or protection of rights.

3. Our Response to Notices

When we receive a notice that substantially complies with applicable requirements, we may promptly remove the reported material or disable access to it.

We may also:

  • Notify the affected user or account holder
  • Forward the complaint or relevant information to that user
  • Temporarily limit features or account access during the review
  • Request additional information from the claimant or the user
  • Preserve records or content related to the complaint
  • Take further action under our Terms of Service or repeat-infringer policy

Guap may decline to act on a notice that is incomplete, unclear, unsupported, not submitted by an authorized party, or otherwise invalid. We may also act more broadly than the specific request when necessary to protect the Service, users, rights holders, or comply with the law.

4. Counter-Notification Process

If your content was removed or access to it was disabled because of a copyright complaint, and you believe that action resulted from a mistake or misidentification, you may submit a written counter-notification to our designated copyright agent.

A counter-notification should include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the URL or location where it appeared before removal.
  3. Your full legal name, mailing address, telephone number, and email address.
  4. A statement, made under penalty of perjury, that you have a good-faith belief the material was removed or disabled because of a mistake or misidentification.
  5. A statement consenting to the jurisdiction of the appropriate federal court for the district in which your address is located. If you are located outside the United States, you must consent to jurisdiction in an appropriate federal judicial district where Guap may be found.
  6. A statement that you will accept service of process from the person who submitted the original infringement notice, or that person’s authorized agent.

If we receive a valid counter-notification, we may forward it to the original claimant. Unless the claimant tells us that it has filed a court action seeking to restrain the allegedly infringing activity, we may restore the material after the waiting period required by applicable law.

Under the DMCA, the usual restoration window is no fewer than 10 and no more than 14 business days after the counter-notice is forwarded, unless the claimant provides notice of a qualifying court action. Guap may take a different approach where required or permitted by applicable law.

5. Preservation and Pending Disputes

Removing or disabling material does not necessarily mean that all associated records are immediately deleted.

We may retain copies of removed content, notices, counter-notices, account records, logs, and related information for a limited period when reasonably necessary to:

  • Comply with legal obligations or valid legal requests
  • Preserve evidence
  • Evaluate or resolve a dispute
  • Enforce our Terms of Service
  • Investigate fraud, abuse, or repeat infringement
  • Protect Guap, our users, rights holders, and the public

We may restrict account features or maintain a temporary enforcement action while a copyright dispute is unresolved.

6. Repeat Infringer Policy

Guap may suspend, restrict, or terminate accounts of users who repeatedly infringe copyrights or otherwise repeatedly violate intellectual-property rights.

When deciding whether action is appropriate, we may consider:

  • The number and nature of valid or credible infringement notices associated with an account
  • Whether content was removed, restored, or found to be non-infringing
  • The user’s history of prior enforcement actions
  • Whether the user responded to notices or engaged in good-faith dispute resolution
  • The seriousness, scope, and apparent intent of the conduct
  • Attempts to evade enforcement through alternate accounts, payment methods, devices, or related activity

Actions may include content removal, disabled links, limited uploads, loss of customization features, account restrictions, suspension, or permanent termination.

Guap may take immediate action in cases involving serious, deliberate, large-scale, or clearly abusive infringement.

7. Misuse of the Copyright Process

Copyright notices and counter-notices must be truthful, complete, and submitted in good faith.

We may reject, limit, or refuse to process submissions that are incomplete, automated, deceptive, abusive, repetitive, improperly targeted, or intended to suppress lawful expression or competition.

We may rate-limit, block, or take other enforcement action against people or entities that repeatedly submit defective, fraudulent, harassing, or bad-faith notices or counter-notices.

Submitting a false statement in a copyright notice or counter-notice may expose the sender to legal liability. Guap does not decide complex ownership disputes, fair-use disputes, or other issues that may require court resolution.

8. Other Intellectual-Property Claims

This policy focuses on copyright complaints. Concerns involving trademarks, impersonation, privacy, publicity rights, counterfeit goods, or other legal issues may be reported to legal@guap.lol.

We may review those reports under our Terms of Service, applicable law, and any relevant policy or legal process. A non-copyright report does not necessarily follow the same process or timelines as a DMCA notice.
