Terms of Service

Guap provides customizable public or private profile pages that may allow users to share links, images, media, social accounts, profile details, and other content.

Your profile may be available to the public depending on your settings and how the Service operates. You are responsible for deciding what to publish and for ensuring that you have the necessary rights, permissions, and authority to post, upload, display, link, or otherwise make that material available.

The Service, including its software, layout, branding, names, logos, interface, visual design, documentation, and Guap-provided assets, is protected by copyright, trademark, and other intellectual-property laws. Except for the limited right to use the Service under these Terms, Guap retains all rights in and to the Service.

You may not copy, reproduce, modify, distribute, sell, rent, lease, sublicense, publicly display, reverse engineer, or create derivative works from the Service unless we provide written permission or applicable law expressly permits it.

We may update these Terms from time to time to reflect changes to the Service, security practices, legal obligations, payment terms, or business operations.

A revised version becomes effective when posted on guap.lol, unless we specify a different effective date. Your continued use of the Service after the effective date means that you accept the revised Terms.

If we make a material change affecting a paid offering, such as a price increase, a change to recurring billing, or removal of a major paid feature, we will make reasonable efforts to notify affected users in advance through the Service or by email.

If you do not agree with an updated version of these Terms, your option is to stop using the Service and, if applicable, cancel your subscription before the next renewal date.

You must use the Service only in compliance with applicable laws and these Terms.

You are responsible for:

• Providing accurate, complete, and current registration and payment information
• Keeping your account credentials confidential
• Maintaining access to the email address associated with your account
• Promptly notifying us of suspected unauthorized access or account activity
• All activity performed through your account, whether or not you personally performed it

Your account is personal to you. You may not sell, rent, transfer, share, sublicense, or otherwise allow another person to use your account or login credentials.

We may investigate and act against coordinated abuse, account sharing, ban evasion, account resales, fraudulent purchases, payment-method reuse, or related conduct. We may apply enforcement across accounts, payment instruments, devices, addresses, or other activity reasonably associated with that conduct.

You must choose and use usernames, profile names, display names, and other identifiers lawfully and in good faith.

We may reclaim, modify, disable, or suspend names that we reasonably believe are:

• Infringing, deceptive, abusive, unlawful, or misleading
• Impersonating another person, company, organization, or Guap representative
• Confusingly similar to an official Guap account or feature
• Designed to mislead others about affiliation, sponsorship, verification, ownership, or endorsement
• Otherwise harmful to users, the platform, or our legal obligations

You remain solely responsible for all content, links, information, and settings associated with your account and profile.

You may use Guap only for its intended purpose and in a manner that does not harm the Service, other users, or third parties.

You must not, and must not help anyone else to:

• Violate any applicable local, state, federal, or international law or regulation
• Access accounts, data, systems, APIs, infrastructure, or restricted areas without authorization
• Attempt to defeat, bypass, probe, interfere with, or circumvent security controls, rate limits, authentication methods, access restrictions, or technical safeguards
• Test, scan, exploit, or search for vulnerabilities without our prior written authorization
• Interfere with the availability, reliability, performance, or security of the Service
• Use bots, scripts, crawlers, scrapers, automated browsers, harvesting tools, or similar automated methods without our written approval
• Impersonate any person, business, government body, brand, or Guap representative
• Misrepresent a relationship with Guap or suggest that Guap has approved, sponsored, partnered with, verified, or endorsed you when it has not
• Upload, distribute, link to, or facilitate malware, ransomware, spyware, exploits, credential theft, phishing, denial-of-service activity, or other harmful code or activity
• Collect personal information from others without a valid legal basis and required consent
• Use the Service to send spam, run scams, mislead users, manipulate traffic, or engage in fraudulent activity
• Use the Service in a way that causes excessive infrastructure, bandwidth, storage, support, or security costs
• Attempt to reverse engineer, decompile, disassemble, or discover source code except where a restriction is prohibited by law

We may monitor, investigate, limit, remove, disable, preserve, report, or take other action regarding content, accounts, or activity that we believe may violate these Terms, threaten the Service, create legal exposure, or harm users or third parties.

Depending on the circumstances, we may act with or without notice.

You may not upload, publish, transmit, display, host, or link to content that violates these Terms or applicable law.

This includes content that:

• Violates another person’s copyright, trademark, privacy, publicity, contractual, or other legal rights
• Is illegal, fraudulent, deceptive, defamatory, harassing, threatening, hateful, discriminatory, or otherwise abusive
• Contains sexually explicit material where prohibited by law or applicable platform rules
• Sexualizes, exploits, depicts, endangers, or facilitates harm to minors
• Includes non-consensual intimate imagery, sexual exploitation, or content obtained or shared without consent
• Promotes, glorifies, threatens, or coordinates real-world violence, terrorism, extremist activity, or violent wrongdoing
• Encourages self-harm or provides instructions intended to facilitate self-harm
• Contains phishing pages, scams, fake giveaways, deceptive investment schemes, or unauthorized data-collection mechanisms
• Contains malicious software, exploit code, distributed-denial-of-service materials, or instructions intended to compromise systems or accounts
• Is otherwise objectionable, harmful, unlawful, or inconsistent with the safe operation of the Service

This list is not exhaustive. We may remove content or take action against an account when we reasonably determine that it creates a safety, security, legal, operational, or community risk.

Where appropriate, we may report unlawful conduct to law enforcement and cooperate with valid legal requests.

Guap’s image and media features are intended for normal personal profile use, including profile visuals, screenshots, clips, and similar content.

They are not intended to function as:

• A general-purpose content delivery network
• An origin server for websites or applications
• A storage layer for automated systems
• A bulk asset-hosting service
• A high-volume hotlinking service
• A backend for bots, scripts, crawlers, or automated publishing pipelines

You may not use Guap media hosting in a way that produces unusually high traffic, bulk uploads, mass hotlinking, automated requests, or other resource usage that is disproportionate to ordinary profile use.

We may limit bandwidth, restrict uploads, reprocess or optimize files, disable access to media, remove files, or suspend related features or accounts when necessary to protect performance, cost, security, legal compliance, or platform availability.

“User Content” means any text, images, graphics, media, links, profile details, custom badges, usernames, or other material that you upload, submit, publish, display, or otherwise make available through the Service.

You retain ownership of your User Content. However, you are fully responsible for it.

By submitting User Content, you represent and warrant that:

• You own the content or have all necessary rights, licenses, permissions, and consents to use it and grant the license below
• Your content does not infringe, misappropriate, violate, or otherwise conflict with another person’s rights
• Your content complies with these Terms and applicable law
• You have obtained any required permissions from people identifiable in your content
• Your content does not contain illegal, harmful, or deceptive material

To operate, maintain, improve, secure, promote, and provide the Service, you grant Guap a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, cache, format, adapt, translate, distribute, display, perform, and create technical or promotional derivative works from your User Content.

This license is limited to purposes reasonably related to the Service and its operation. For example, the license allows us to display your public profile, generate image sizes, cache content for faster delivery, create backups, detect abuse, and feature content in Service-related promotional materials where permitted.

To the extent allowed by applicable law, you waive or agree not to assert moral rights or similar rights that would prevent us from using User Content as permitted by this license.

The license generally ends when you remove the applicable User Content or close your account. However:

• Content may continue to exist in backups, logs, caches, audit records, or security systems for a limited period
• We may retain content where necessary for legal compliance, fraud prevention, dispute resolution, security, enforcement, or recordkeeping
• Content copied, embedded, downloaded, reposted, or otherwise shared by others outside our control may remain available elsewhere

We do not claim ownership of your User Content.

Guap may make certain icons, graphics, animations, badges, templates, or other assets available for use on profiles.

Unless we expressly state otherwise, these assets are licensed only for use on Guap and only in accordance with these Terms, any feature-specific rules, and applicable third-party license terms.

Custom badges and related designs must be original to you or used with valid authorization. You may not copy, imitate, recreate, or create confusingly similar versions of official Guap badges, logos, marks, visual identifiers, or platform assets.

We may review, reject, restrict, alter, remove, or disable badges that violate these Terms, create legal risk, infringe rights, or misuse the badge system. Abuse of customization features may result in partial or permanent loss of access to those features.

The Service may allow you to add links to, display content from, or connect accounts with third-party platforms, including social networks, messaging services, payment providers, and websites.

Third-party services are independent from Guap. Their own terms, privacy notices, rules, and practices govern your use of them.

If you connect a third-party account, you authorize us to receive, use, and store the information that the third party provides to us based on the permissions you grant and your settings with that third party.

Guap does not control and is not responsible for third-party websites, products, services, content, availability, security, policies, or conduct. Your use of third-party services and external links is at your own risk.

You may add lawful third-party links to your profile, but you may not use them to violate these Terms or falsely imply that Guap endorses, sponsors, verifies, or partners with the linked destination.

Certain parts of the Service may require payment.

Unless stated otherwise, listed prices do not include taxes, payment processing costs, or other charges that may apply. The final amount will be shown to you at checkout and may depend on your location, chosen payment method, and the product or plan selected.

By placing an order or starting a paid plan, you agree that:

• The billing, contact, and payment information you provide is accurate and current
• You authorize Guap and its payment providers to charge the displayed amount, plus applicable taxes, fees, and recurring charges where applicable
• You will keep your payment method, billing address, email address, and payment details current
• You are responsible for all charges incurred through your account

We may change prices, introduce fees, discontinue offerings, or modify available plans in the future. A pricing change will not alter a payment already completed except to correct a clear error or where required by law.

We may refuse, cancel, or limit orders at our discretion. We may also impose purchase limits by person, household, account, payment method, billing address, shipping address, device, or other reasonable criteria.

We may refuse orders that appear to involve resale, distribution, dealer activity, fraud, abuse, or attempts to evade purchase limits.

If we identify an incorrect price, product description, charge, or transaction, we may correct the error, including by canceling an order, adjusting a charge, issuing a credit, or requesting payment of the correct amount where legally permitted.

Except where required by applicable law, payments for Guap products, subscriptions, upgrades, and digital features are non-refundable.

We do not generally issue refunds for:

• A change of mind
• Unused time on a subscription
• Partial use of a paid period
• Failure to use the Service
• Forgetting to cancel before renewal
• Features removed or restricted because of a violation of these Terms

If we make a verified billing error, such as charging the wrong amount, charging for the wrong item, or processing an unauthorized duplicate transaction, we may provide a refund or account credit as appropriate.

To report a billing issue, contact us at support@guap.lol and include your account email, transaction details, and a clear description of the concern.

Initiating a chargeback or payment dispute for a legitimate charge without first attempting to resolve the matter with us may be considered a violation of these Terms. We may suspend or restrict your account, paid features, purchases, or future transactions while a dispute is pending, and may terminate access after fraudulent or abusive disputes.

Nothing in this section limits rights that cannot legally be waived.

We use reasonable administrative, organizational, and technical measures designed to protect the Service and user data. However, no online service, storage system, or transmission method is completely secure.

We cannot guarantee that the Service will always be secure, uninterrupted, error-free, available, or free from data loss.

You are responsible for safeguarding your password, authentication methods, recovery codes, and devices. Do not share access credentials with anyone.

If you believe your account has been compromised, you see an unknown session or login, or you suspect unauthorized use, contact support@guap.lol promptly.

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, retain, disclose, and protect personal information.

By using the Service, you acknowledge the practices described in the Privacy Policy.

When a verified account-deletion request is completed, we will remove or de-identify active account information and User Content as described in our Privacy Policy and as required by applicable law.

Some information may remain temporarily in backups, system logs, fraud-prevention systems, security records, or legal-compliance records. These retained copies are kept only for legitimate operational, security, dispute-resolution, audit, or legal reasons and are deleted or rotated according to our retention practices.

You are responsible for creating and maintaining your own backups of any User Content or account data you want to preserve. We are not responsible for loss, corruption, deletion, or unavailability of content or data.

We respect intellectual-property rights and expect users to do the same.

If you believe that material on the Service infringes your copyright, you may submit a written copyright complaint to legal@guap.lol. Your notice should include the information required under applicable law, including the identification of the copyrighted work, the location of the allegedly infringing material, your contact details, a good-faith statement, a statement made under penalty of perjury, and your physical or electronic signature.

We may remove or restrict access to allegedly infringing material, disable accounts, or take other action when appropriate.

If you believe your content was removed by mistake or misidentification, you may submit a valid counter-notice as permitted by applicable law.

We may terminate or restrict accounts of repeat infringers or users who repeatedly violate intellectual-property rights.

These Terms begin when you first access or use the Service and continue until terminated.

You may stop using the Service at any time. You may also close your account through available account tools or by contacting support where required.

We may suspend, limit, disable, remove, or terminate your access, account, content, purchases, or features if we reasonably believe that:

• You violated these Terms, another Guap policy, or applicable law
• You created a safety, security, operational, financial, or legal risk
• You engaged in fraud, abuse, chargeback abuse, impersonation, or harmful activity
• You failed to pay amounts due
• We are required to do so by law, a court order, or a valid government request
• We need to protect users, the Service, our partners, or our infrastructure
• Continuing to provide the Service is no longer commercially or operationally practical

We may take these actions with or without notice when we believe immediate action is appropriate.

Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, payments, disclaimers, liability limitations, indemnification, dispute resolution, and enforcement.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Guap, its owners, affiliates, licensors, service providers, employees, contractors, officers, directors, agents, and representatives from and against any claims, damages, losses, liabilities, penalties, costs, and expenses, including reasonable attorneys’ fees and expert fees, arising out of or related to:

• Your User Content
• Your use or misuse of the Service
• Your violation of these Terms or applicable law
• Your infringement or violation of another person’s rights
• Your dealings with third parties through the Service
• Any activity conducted through your account

We may assume exclusive control of the defense and settlement of a matter subject to indemnification. If we do, you agree to cooperate with us reasonably and in good faith.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUAP DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.

WE DO NOT GUARANTEE THAT:

• THE SERVICE WILL ALWAYS BE AVAILABLE OR UNINTERRUPTED
• THE SERVICE WILL BE SECURE OR FREE FROM VIRUSES, DEFECTS, OR ERRORS
• CONTENT OR DATA WILL NEVER BE LOST, ALTERED, OR CORRUPTED
• DEFECTS WILL ALWAYS BE CORRECTED
• THIRD-PARTY LINKS OR CONTENT WILL BE SAFE, ACCURATE, OR APPROPRIATE

YOU USE THE SERVICE AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUAP AND ITS OWNERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, CONTRACTORS, OFFICERS, DIRECTORS, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR USE, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUAP’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID TO GUAP FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
• $100 USD

Some jurisdictions do not permit certain warranty exclusions or limitations of liability. In those jurisdictions, the above limitations apply only to the extent permitted by law.

We may disclose account information, content, records, or other data when we believe disclosure is necessary or appropriate to comply with applicable law, a valid legal request, a court order, or government process, or to protect the rights, safety, security, and property of Guap, users, or the public.

Law-enforcement agencies, government authorities, and rights holders may direct valid legal requests to legal@guap.lol.

These Terms do not create an employment relationship, partnership, joint venture, agency relationship, franchise, or fiduciary relationship between you and Guap.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, corporate restructuring, financing, sale of assets, or operation of the Service.

If any part of these Terms is found unenforceable, that part will be enforced to the maximum extent allowed by law, and the remaining provisions will remain in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms, together with the Privacy Policy and any additional policies or terms expressly incorporated by reference, form the entire agreement between you and Guap regarding the Service.
